Chapter 263: About the Forbiddance of Exaggeration in Punishing

Chapter Introduction

٢٦٣ـ باب النهي عن تعذيب العبد والدابة والمرأة والولد

Translation: Allah said:

الْقُرْآنُ الْكَرِيمُسُورَةُ النِّسَاءِ (4:36)
وَاعْبُدُوا اللَّهَ وَلَا تُشْرِكُوا بِهِ شَيْئًا ۖ وَبِالْوَالِدَيْنِ إِحْسَانًا وَبِذِي الْقُرْبَىٰ وَالْيَتَامَىٰ وَالْمَسَاكِينِ وَالْجَارِ ذِي الْقُرْبَىٰ وَالْجَارِ الْجُنُبِ وَالصَّاحِبِ بِالْجَنبِ وَابْنِ السَّبِيلِ وَمَا مَلَكَتْ أَيْمَانُكُمْ ۗ إِنَّ اللَّهَ لَا يُحِبُّ مَن كَانَ مُخْتَالًا فَخُورًا
( سُورَةُ النِّسَاءِ (4:36) )

Translation: " Worship Allah and join none with Him in worship; and do good to parents, kinsfolk, orphans, the needy, the neighbor who is near of kin, the neighbor who is a stranger, the companion by your side, the wayfarer (you meet), and those (slaves) whom your right hands possess. Verily, Allah does not like such as are proud and boastful * " S: 4-36.

Translation: The Messenger of Allah said:

Hadith 896: Hadith 896

٨٩٦ - حديث عَبْدِ اللَّهِ بْن عُمَرَ ، أَنََّّ رَسُولَ اللَّهِ ، قَالَ : : عُذِّبَتِ امْرَأَةٍ هِرَّةٍ سَجَنَتْهَا حَتَّى مَاتَتْ ، فَدَخَلَتْ فِيهَا النَّارَ ، لَا هِيَ أَطْعَمَتُهَا وَلَا سَقَتْهَا إِذْ هِيَ حَبَسَتْهَا ، وَلَا هِيَ تَرَكَتْهَا تَأْكُلُ مِنْ خَشَاشِ الْأَرْضِ أخرجه البخاري

Translation: 896. Narrated Abdullah ibn Omar may Allah be pleased with her; " Allah's Messenger said: " A woman was punished because she imprisoned a cat till it died. She entered Hellfire because of it. She neither gave it food, water, nor she set it free to eat of the vermin of the earth. " (Bukhari).

Hadith 897: Hadith 897

۸۹۷ - حَدَّثَنَا أَبُو كُرَيْبٍ حَدَّثَنَا الْمُحَارِبِيُّ عَنْ شُعْبَةَ عَنْ حُصَيْنٍ عَنْ هِلَالِ بْنِ يَسَافٍ عَنْ سُوَيْدِ بْنِ مُقَرْنِ الْمُرَنِي قَالَ لَقَدْ رَأَيٌُّّتُنَا سَبْعَةَ إِخْوَةٍ مَا لَنَا خَادِمٌ إِلَّا وَاحِدَةً فَلَطَّمَهَا أَحَدْنَا فَأَمَرَنَا النَّبِيََََُُُِّّّّّّّّ صَلَّى اللّٰهُ عَلَيْهِ وَسَلَّمَ أَنَّ نُعْتِقَهَا قَالَ وَفِي الْبَابِ عَنْ ابْنِ عُمَرَ قَالَ أبو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ وَقَدْ رَوَى غَيْرُ وَاحِدٍ هَذَا الْحَدِيثَ عَنْ حُصَيْنِ بْنِ عَبْدِ الرَّحْمِنْ فَذَكَرَ بَعْضُهُمْ فِي الْحَدِيثِ قَالَ لَطَمَهَا عَلَى وَجْهِهَا *

Translation: 897. Narrated Sowayd ibn Moqarrin Al-Mozani; ' We were seven brothers and we had but only a female servant. One of us slapped her and the Prophet ﷺ ordered us to emancipate her. '

Hadith 898: Hadith 898

۸۹۸ - حَدَّثَنَا مَحْمُودُ بْنُ غَيلانَ حَدَّثَنَا مُؤمَلٌ حَدَّثَنَا سُفْيَانُ عَن الْأَعَمٍّشِ عَنْ إِبْرَاهِيمَ التَّيْمِيِّ عَنْ أَبِيهِ عَنْ أَبِي مَسْعُودٍ الْأَنْصَارِي قَالَ كُنْتُ أَضْرِبُ مَمَلُوكًا لِي فَسَمِعْتُ قَائِلا مِنْ خَلْفِي يَقُوَلَاعْلَمْ أَبَا مَسْعُودٍ اعْلَمْ أَبَا مَسْعُودٍ فَالْتَفَتْ فَإِذَا أَنَا برَسُول اللَّهُ ) . صَلَّى اللّٰهُ عَلَيْهِ وَسَلَّمَ فَقَالَ لَلَّهُ أَقْدَرُ عَلَيْكَ مِنْكَ عَلَيْهِ قَالَ أَبُو مَسْعُود فَمَا ضَرَبْتُ مَمْلُوكًا لي بَعْدَ ذَلِكَ قَالَ أبو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ وَإِبْرَاهِيمُ التَّيْمِيُّ إِبْرَاهِيمُ بْنُ يَزِيدَ بْنِ شَرِيكَ

Translation: 898. Narrated Abu-Mas'oud Al-Ansari; ' I was hitting a slave of mine and I heard someone calling me: " Know Abu- Mas'oud! Know Abu-Mas'oud! I turned and saw the Messenger of Allah. He said: " Indeed, Allah is More Capable over you than you are over him. " Abu-Mas'oud said; ' I never hit a slave since then. "
